⚖️ Statutory Right of Withdrawal: As a consumer purchasing online, you have the right to withdraw from the contract within 14 calendar days without giving any reason, in accordance with EU Directive 2011/83/EU, the Polish Consumer Rights Act (Ustawa o prawach konsumenta, Dz.U. 2014 poz. 827) and the Ukrainian Law on Consumer Protection (Закон України «Про захист прав споживачів»).
§1. Right of Withdrawal (Prawo odstąpienia / Право відмови)
You may withdraw from a distance contract concluded with Parla della morale within 14 calendar days from the day on which you acquired physical possession of the goods, without giving any reason and without incurring any costs, except as described in §4.
To exercise the right of withdrawal, you must inform us of your decision by means of a clear, unambiguous statement (e.g., a letter sent by email). You may use the model withdrawal form at the end of this document, but it is not obligatory.
The withdrawal period will expire 14 days from the day after the day you receive the goods. If the order contains multiple items delivered separately, the period starts from receipt of the last item.
§2. How to Return an Item (Jak dokonać zwrotu / Як повернути товар)
- Send your withdrawal notice to: [email protected]
- Subject line: RETURN / ORDER #[your order number]
- Include your full name, order number, and the items you are returning
- Ship the goods back within 14 calendar days of sending your withdrawal notice
- Securely package the items to prevent damage in transit
- We recommend using a tracked shipping service — we are not responsible for items lost in return transit
- Return shipping address will be provided in response to your return request email
§3. Conditions of Return (Warunki zwrotu / Умови повернення)
Items must be returned in their original, unworn condition. Specifically:
- Tags and original packaging must be intact
- Items must show no signs of use, washing, or alterations
- Hygienic items (e.g., underwear, intimate apparel) are excluded from the right of withdrawal once opened
- Custom-made or personalised items are excluded from return rights
- Items damaged by the customer will not be accepted
We reserve the right to reduce the refund amount if the goods have been handled in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
§4. Refund Process (Zwrot płatności / Повернення коштів)
Upon receipt and inspection of the returned goods, we will process your refund within 14 calendar days. The refund will be issued using the same payment method you used for the original transaction, unless you have expressly agreed otherwise.
We may withhold the refund until we receive the returned goods or until you provide proof of having sent them back, whichever is earlier.
Deductions from refund:
- Return shipping costs are borne by the customer, unless the return is due to a defective or incorrectly shipped item
- Original delivery costs are refunded only up to the cost of the cheapest standard delivery option available
§5. Defective or Incorrect Items (Reklamacje / Рекламації)
If you have received a defective, damaged, or incorrect item, please contact us immediately at [email protected] with photos of the defect. We will:
- Cover return shipping costs for defective/incorrect items
- Offer a full refund, replacement, or repair at our discretion
- Respond within 5 business days
Polish law (Rękojmia): In accordance with Art. 556–576 of the Polish Civil Code, physical defects discovered within 2 years of delivery are covered under statutory warranty (rękojmia). Complaints must be submitted within 1 year of discovering the defect.
Ukrainian law: Defective goods are subject to the warranty provisions of the Law of Ukraine «On Consumer Protection» (Art. 8), allowing for replacement, repair, price reduction, or refund.
§6. Complaint Procedure (Procedura reklamacyjna / Процедура рекламації)
- Submit a complaint via email to [email protected]
- Include: your full name, order number, description of the issue, and photos if applicable
- We will respond with a decision within 14 days of receiving the complaint
- If we do not respond within 14 days, the complaint is considered accepted (Polish law: Art. 7a of the Consumer Rights Act)
§7. Out-of-Court Dispute Resolution
Poland: Polish consumers have the right to use out-of-court dispute resolution. You may contact the Regional Trade Inspection Authority (Inspekcja Handlowa), local consumer ombudsman (Powiatowy Rzecznik Konsumentów), or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Ukraine: Ukrainian consumers may submit complaints to the State Service of Ukraine on Food Safety and Consumer Protection (Держпродспоживслужба) or seek dispute resolution through courts of general jurisdiction.
